Once a removal occurs, the parent has the right to an emergency custody hearing within 72 hours. At that time the court decides whether the child shall remain in the temporary custody of DCF or other third party custodian or be returned to the parent. If the parent does not get custody at that time, then the case proceeds to motion, pre-trial and then a trial date to determine if the parent is unfit.
