The matters below are representative examples of that work. Darin served as lead trial and appellate counsel in Gresser v. Banner Health, which resulted in the largest medical malpractice verdict in Colorado history. A Weld County jury awarded more than $27 million in economic damages, and the case ultimately resolved for over $50 million following appellate proceedings. He successfully defended the verdict before the Colorado Court of Appeals and the Colorado Supreme Court. In a unanimous 7–0 decision, the Supreme Court clarified that when good cause exists to exceed statutory caps, the jury, not the court, determines the full amount of damages. In Bayes v. Biomet, a federal case in Missouri involving a defective metal-on-metal hip implant, Darin served as lead trial counsel in a $21 million jury verdict, the largest compensatory damages verdict of its kind in the United States, which was upheld on appeal. Darin is a past president of the Colorado Trial Lawyers Association, was named Outstanding Trial Attorney for the State of Colorado, and has been selected to Super Lawyers since 2007.
