Criminal Injury Claims

A criminal injury differs from a personal injury somewhat and involves you being an innocent onlooker to a criminal act and becoming injured as a result. In these instances, the person you will claim compensation from will be the criminal and you can claim even if they haven’t been caught or convicted.

“The Criminal Injuries Compensation Authority is a government funded scheme to compensate blameless victims of violent crime. Payment can never fully compensate for the injuries suffered, but it is recognition of public sympathy”.

The Criminal Injuries Authority (CICA) an agency of the Ministry of Justice (MoJ) and, if you plan on making a claim, there is a time limit of two years after the event.

Who is eligible?

You may be eligible to claim for criminal injury if:

  • You have been the victim of a violent crime
  • You hold no blame and did not cause the accident in any way
  • You were injured when trying to stop a crime
  • A loved one was the victim of a violent crime and, as a witness, you were psychologically injured
  • A relative has died because of a violent crime

If you are a relative of someone who has passed away as a result of a violent crime then you’ll only be able to claim if you are:

  • A married or unmarried spouse or partner (of the same or opposite sex) providing you were cohabiting at the time
  • Parents, adoptive parents or a guardian of the victim
  • The child (natural, adopted or someone widely accepted as their child) of the victim

Exceptions to the rule

In the majority of cases these rules will stand. However, CICA have set out some exceptions to these rules which could affect your right to claim compensation:

  • Failure to report the crime to the police
  • If your behaviour may have led to the injury
  • You hold a criminal record
  • You were uncooperative with the police or CICA

Other than these few exceptions, if you are deemed to have been injured because of a criminal act and you were completely blameless in the incident, then they should agree to award you with compensation.
